Description: Learn how to complete and file use-based and intent-to-use applications for registration of trademarks and service marks with the United States Patent and Trademark Office, how to choose and submit appropriate specimens of use, and how to prepare and file disclaimers and other kinds of responses to office actions. Guidance will also be provided on the legal and ethical considerations relating to the meaning of “practice of law” and to attestations and signatures. Finally, learn about opposition and cancellation proceedings under the Trademark Modernization Act and ongoing maintenance and renewal obligations.

Disclaimer: This course will not provide instruction on evaluating a trademark for registrability. It is assumed that a supervising attorney will have made that determination prior to commencing the trademark registration process.

Thomas James is a private practice attorney focusing on trademark and copyright law, and a member of the ABA-IPL Copyright and Emerging Technology Committee. He practices in Minnesota and is also admitted to the Federal Circuit Court of Appeals and the United States Supreme Court. He has prosecuted trademark registrations and represented clients in Trademark Trials and Appeals Board (TTAB) proceedings. He is the author of E-Commerce Law, IP Law for Non-IP Attorneys, and the IP law blog, The Cokato Copyright Attorney.
