Description: This course explores how intellectual property is dealt with in probate cases. Intellectual property includes copyrights, trademarks, patents, trade secrets, and publicity rights. Topics covered include choice of law (federal vs. state), inheritance rights, rules of intestate succession, perfecting and protecting inherited interests in intellectual property, fiduciary duties, and how to make distributions of intellectual property. Although not required, a basic understanding of the probate process will be helpful.

- Determine how to identify the various kinds of intellectual property
- Discover how to find the inheritance laws relevant to particular kinds of intellectual property
- Gain insight into the inheritance laws applicable to intellectual property
- Develop an understanding of the legal requirements for maintaining and distributing intellectual property in a probate case.

Presenter Biography: Thomas James is a private practice attorney with over twenty years of experience, focusing on trademark and copyright law. He is a member of the ABA-IPL and Copyright and Emerging Technology Committees. He practices in Minnesota and is also admitted to the Federal Circuit Court of Appeals and the United States Supreme Court. He has prosecuted trademark registrations and represented clients in Trademark Trials and Appeals Board (TTAB) proceedings. He is the author of E-Commerce Law, IP Law for Non-IP Attorneys, the blog, The Cokato Copyright Attorney, and several law review articles.
