Description: Personal injury firms have ethical responsibilities at settlement beyond maximizing recovery. Settlement language and planning typically affect how much of a recovery the plaintiff can keep. Often, proper settlement planning changes what they keep by more than half.
This presentation will cover your firm’s ethical obligations and how to exclude specialized subjects (tax, finance, government benefits) from your firm’s scope of representation. It will offer techniques for spotting risks and opportunities and explain the critical effect of settlement language on the treatment of settlement proceeds. It will explore how to maximize plaintiff recovery through solutions such as trusts, escrows, settlement funds, structured settlements, and Medicare Set-Aside Accounts.

Instructor Biographies: Jeremy Babener is a tax lawyer and settlement consultant to personal injury plaintiffs and lawyers. He writes on settlement planning for Forbes, Bloomberg, and the ABA and presents to trial lawyers across the country.

Rachel is Chief Trust Officer at Eastern Point Trust Company, which offers all manner of settlement-related trusts. She regularly coordinates qualified settlement funds, plaintiff recovery trusts, and settlement escrow trust solutions. She consults on efficiencies and workarounds to make sure cases close quickly while preserving flexibility of settlement options, including structured settlements, attorney fee deferral, and lien resolution.
