– Examination of the risks associated with using generative AI to prepare pleadings, discovery responses, deposition summaries, and motions in civil litigation.
– Application of the Texas Rules of Civil Procedure, including Rules 13 (Signing of Pleadings), 192 (Permissible Discovery), and 215 (Abuse of Discovery; Sanctions), along with Texas Disciplinary Rules of Professional Conduct 3.03 (Candor Toward the Tribunal).
– Attorney obligations to verify AI-generated factual assertions, legal authorities, quotations, and discovery summaries, and potential consequences of submitting inaccurate or fabricated information to the court.
