Description: Adam J. Schwartz, Esq., served as a document review and ESI consultant in Breaking Code Silence v. McNamara, a two-year litigation involving Slack preservation, collection, and review. The case underscores the critical role paralegals and litigation-support professionals play in defensible discovery—from mapping systems and tracking custodians to validating exports, preserving context, and identifying production gaps. The matter ultimately resulted in dismissal with prejudice and $15,342 in monetary sanctions related to delayed Slack production. Using the case as a road map, this session provides a repeatable workflow for preserving, collecting, reviewing, validating, producing, documenting, and escalating Slack data and other modern ESI.
