2. How to de-escalate difficult situations
3. How to form relationships of trust
Session 3: An introduction to and discussion of best practices for interviewing and counseling clients taking ethical considerations into account.
Learning Objectives:
By the end of this presentation, participants will be able to:
1. Identify the scope of a paralegal’s role in client interviewing and counseling under the Florida Rules of Professional Conduct, including the limits imposed by the unauthorized practice of law.
2. Understand key Florida ethics rules, including Rules 4-1.1 (Competence), 4-1.2 (Scope of Representation), 4-1.4 (Communication), 4-2.1 (Advisor), and 4-5.3 (Responsibilities Regarding Nonlawyer Assistants) in real-world client interactions.
3. Differentiate between permissible information gathering and impermissible legal advice and recognize when an issue must be escalated to a supervising attorney.
4. Conduct structured and effective client interviews
