Arbitration, Mediation, and Other Dispute Resolution Options

• Participants will be able to identify and distinguish between common forms of alternative dispute resolution (ADR), with a specific focus on mediation and arbitration, including the purpose of each process, the role of the neutral, and how mediation and arbitration differ from litigation in structure, outcomes, and party control.
• Participants will be able to explain the key benefits of mediation to clients, including efficiency, cost savings, confidentiality, flexibility in outcomes, preservation of relationships, and increased likelihood of voluntary compliance when compared to arbitration and traditional litigation.
• Participants will be able to assist attorneys in preparing clients for mediation, including educating clients on the mediation process, setting realistic expectations, organizing relevant documents and information, and supporting effective participation during the session.
