Synopsis:
Legal update on the HIPAA attestation requirements and helpful steps for paralegals to successfully submit a record request.
The HIPAA attestation requirement, introduced by the 2024 final rule for reproductive health care privacy, is no longer in effect due to a legal challenge. Previously, this rule required certain entities to obtain a signed statement from requestors of protected health information (PHI) to ensure the information was not for prohibited purposes, such as investigating lawful reproductive health care. Existing HIPAA rules still needed to be maintained when requesting PHI information.
