Leave issues: Explaining FMLA, other protected leave, and the process for handling requests and returns from leave

This will be a membership meeting and dinner followed by a CLE presentation by Attorney R. Michelle Tatum-Bush, employment law and litigation partner at Ford Harrison LLP.

1. Explain the key provisions of the Family and Medical Leave Act (FMLA), including employee eligibility, qualifying reasons for leave, and the duration of protected leave.

2. Identify other types of legally protected leave under federal, state, or local laws (e.g., ADA-related leave, pregnancy disability leave, military leave, jury duty, and paid sick leave mandates).

3. Differentiate between protected leave and discretionary leave, understanding employer obligations versus optional accommodations.

4. Describe the correct procedures for handling leave requests, including notice requirements, documentation (e.g., medical certification), and confidentiality considerations.

5. Outline the employer’s responsibilities during leave, such as benefits continuation, job protection, and communication protocols.
